Germany Freelancer Invoice & Kleinunternehmer 2026
German freelancer invoicing 2026: §19 UStG Kleinunternehmer thresholds, §14 UStG fields, §18 EStG Gewerbesteuer, B2B e-invoicing 2025/2027, GoBD §147 AO.
Quick Answer
German freelancers and small business owners can issue invoices without registering a business first. There is no "invoice licence" in Germany. Before your first invoice lands, two things are mandatory: a Steuernummer (tax number) from your Finanzamt, and (if you are VAT-registered) a properly issued invoice that satisfies §14 UStG (Umsatzsteuergesetz). The two paths split immediately. If your previous-year VAT-exclusive turnover (Umsatz) is under €22,000 AND you expect €50,000 or less in the current year, you can stay on the Kleinunternehmerregelung (§19 UStG): no VAT on your invoices, no VAT return, but no Input Tax Credit (Vorsteuerabzug) on your business expenses. If you exceed either threshold, or you simply want the Vorsteuerabzug, you must charge 19% Umsatzsteuer (7% for certain work like writing and teaching) and file Umsatzsteuervoranmeldung monthly or quarterly. Most §18 EStG "Katalogberufe" (catalogue professions: writers, journalists, engineers, architects, doctors, accountants, tutors) are exempt from Gewerbesteuer. If you run a Gewerbe (trade), trade tax kicks in once annual profit clears €24,500 (Freibetrag). Every VAT-applicable invoice must carry eight legally required fields under §14 Abs. 4 UStG: full name and address of supplier and customer, your Steuernummer or USt-IdNr, invoice date, description of service, date of performance, net amount, VAT rate and amount, and (since 2013) a sequential invoice number. Records must be retained 10 years under §147 AO (Abgabenordnung) in GoBD-compliant form: digital, tamper-evident, and traceable. Our free DE invoice templates at /de/de/invoice-generator produce Kleinunternehmer and Regelbesteuerung variants with all §14 UStG fields. For Gewerbesteuer exposure, complex reverse-charge cases, and the new B2B e-invoicing mandate (Wachstumschancengesetz, mandatory from 2025/2027), you will still need a Steuerberater.
What German freelancers call themselves — and why the Finanzamt cares
Germany has three distinct legal statuses for freelance work, and the Finanzamt treats each one very differently. Picking the wrong one means years of back-collected Gewerbesteuer:
The §18 EStG Katalogberufe catalogue is closed — there is no "engineer" without a specific engineering diploma, no "consultant" unless the work is on the catalogue. Software developers are §18 EStG if their work is creative-technical design (not just coding-to-spec). If you fall outside, you register a Gewerbe at the local Gewerbeamt and pay Gewerbesteuer to your municipality.
For invoicing purposes, both statuses use the same §14 UStG invoice fields — what differs is the bottom-line tax you owe.
| Status | What you call it | Tax filing form | Gewerbesteuer? | VAT? |
|---|---|---|---|---|
| Freiberufler | "I'm self-employed" (Katalogberuf per §18 Abs. 1 Nr. 1 EStG) | Anlage S (Einkommensteuererklärung, gewerbliche Einkünfte annex) | No — exempt by §18 EStG | Yes (Kleinunternehmerregelung or Regelbesteuerung) |
| Gewerbetreibender | "I run a trade" (any non-§18 work, e.g. trading, agency, consulting not on the catalogue) | Anlage G + Gewerbesteuererklärung | Yes, after Freibetrag €24,500 | Yes |
| Selbstständiger (employee-like, Scheinselbstständige) | One-client risk, integrated into client's org | Statusfeststellungsverfahren (Rentenversicherung clears it) | Depends | Yes |
The Kleinunternehmerregelung (§19 UStG) decision tree
The Kleinunternehmer rule is not a registration status. It is an option under §19 UStG that you choose by simply not charging VAT on your invoices — but only if you stay below the thresholds:
`` Did your previous-year VAT-exclusive Umsatz stay under €22,000? ├── No → must charge VAT (Regelbesteuerung) from January 1 of the next year └── Yes Do you expect ≤ €50,000 in the current year? ├── No → must charge VAT (Regelbesteuerung) prospectively └── Yes → Kleinunternehmer OK, but you may opt into Regelbesteuerung voluntarily (do this if you have high Vorsteuer, e.g. hardware or vehicle purchases) ``
When to opt into Regelbesteuerung voluntarily: if your Vorsteuerabzug (input tax credits) on business purchases (laptop, software, co-working, training) is higher than the VAT you collect from clients, the voluntary option locks you in for 5 years per §19 Abs. 3 UStG. It saves money when you carry heavy equipment costs. Run the numbers with your Steuerberater before year-end.
The hidden trap: once you exceed €50,000 mid-year, you must switch mid-year with retroactive effect from the start of that quarter. Clients who already paid "net" invoices must be re-invoiced with VAT. The Finanzamt does not accept "the invoice already went out" — get this right before you cross the line.
The 8 §14 UStG invoice fields you must include (if you charge VAT)
This is the full checklist for every VAT-applicable invoice under §14 Abs. 4 UStG:
Kleinunternehmer invoices are simpler: you omit fields 7 and 8 and you must include the literal sentence "Gemäß § 19 UStG wird keine Umsatzsteuer berechnet". Without that sentence, you are deemed to have charged VAT and must remit it to the Finanzamt even if you intended Kleinunternehmer status.
| # | Field | Where it goes on the invoice | Common mistake |
|---|---|---|---|
| 1 | Full name + address of supplier (you) | Top | Using a trade name only — must include legal name |
| 2 | Full name + address of customer (your client) | "Bill to" block | Foreign B2B clients — use their registered office address |
| 3 | Your Steuernummer or USt-IdNr | Top header | Kleinunternehmer invoices must include "Gemäß §19 UStG wird keine Umsatzsteuer berechnet" instead |
| 4 | Invoice date | Header | Use the date the invoice is issued, not the date of work |
| 5 | Description of service + quantity | Body line items | "Consulting services" is too vague — write "Marketing strategy workshops, 8 hours, Sept 2026" |
| 6 | Date / period of performance | Body or footer | A single-day service needs only one date; multi-month needs a period |
| 7 | Net amount + VAT rate + VAT amount + gross amount | Totals block | Split 19% and 7% lines if mixed; never round VAT |
| 8 | Sequential invoice number | Header | Gapless, unique, ideally timestamp-based so duplicate-detection is easy |
The §18 EStG catalogue — and why consultants get caught out
The Katalogberufe under §18 Abs. 1 Nr. 1 EStG include (non-exhaustive):
The classic case where consultants misclassify: a "business consultant" who actually does sales / agent work is NOT §18 EStG — that is a Gewerbe. The Finanzamt's H 18.2 EStH (Einkommensteuer-Hinweise) is the official commentary and lists ~30 sub-categories with examples. If your work involves selling someone else's products, taking commissions, or running a marketing agency that buys media, you are almost certainly Gewerbe, not Freiberufler.
For software developers: §18 EStG applies if your work is "eigenverantwortlich und kreativ" (self-directed and creative) per BFH ruling V R 69/09 (the "Künstlereigenschaft" test). Pure coding-to-spec without design authority does not qualify — you are Gewerbe. The Finanzamt's position is conservative; if you are in doubt, register as Gewerbe and budget for trade tax.
- Wissenschaftliche, künstlerische oder schriftstellerische Tätigkeit (scientific, artistic, or literary work): authors, journalists, designers, photographers, translators
- Lehrende / Unterrichtende Tätigkeit (teaching): trainers, tutors, language teachers
- Wirtschaftsberatende / steuerberatende Tätigkeit (business consulting / tax consulting): management consultants, Steuerberater themselves, financial advisors
- Technische / naturwissenschaftliche Beratung / Gutachten (technical / scientific consulting / expert opinions): engineers, IT architects, patent attorneys
- Heilbehandlung / Gesundheitsberufe (medical / health): doctors, physiotherapists, psychologists, Heilpraktiker
- Informationsvermittlung (information brokering)
Trade tax (Gewerbesteuer) exposure for misclassified freelancers
Once you register as Gewerbe, the Gewerbesteuer kicks in:
This is why misclassifying as Gewerbe is expensive. The "I registered Gewerbe because it was easier" decision made in year 1 can cost €10k-€30k/year by year 5. The flip side: reclassifying from Gewerbe back to Freiberufler requires an Abmeldung of the Gewerbe and a §18 EStG declaration to the Finanzamt — usually doable, but the historical Gewerbesteuer cannot be refunded.
| Profit per year | Tax you owe |
|---|---|
| ≤ €24,500 | €0 (Freibetrag per §11 Abs. 2 GewStG) |
| > €24,500 | 7% of profit × your Hebesatz (municipal multiplier, typically 400-900%) |
| Example: €80,000 profit, 450% Hebesatz | 7% × 450% × €80,000 = €25,200/year to your municipality |
The B2B e-invoicing mandate — what's mandatory now (Wachstumschancengesetz)
Germany's Wachstumschancengesetz (Growth Opportunities Act, in force since 27 March 2024) introduced a phased B2B e-invoicing mandate under §14 Abs. 2 Satz 2 UStG (new):
What this means for you: if you invoice only German businesses, you must issue XRechnung or ZUGFeRD from 2025. If you invoice B2C (consumers) or foreign clients, paper and PDF are still acceptable. Most freelance template tools (including ours) need a ZUGFeRD 2.x plugin to comply. Flat PDFs are not compliant from 2028.
| Date | What became mandatory |
|---|---|
| 2025-01-01 onwards | All B2B invoices between German-resident VAT-registered businesses must be issued as e-invoices (XRechnung or ZUGFeRD 2.x formats), except for amounts ≤ €250 |
| 2027-01-01 onwards | All B2B invoices (no minimum amount) must be e-invoices; paper and PDF are no longer compliant |
| 2028-01-01 onwards | EDI-based formats are also permissible in addition to XRechnung / ZUGFeRD |
GoBD-compliant digital records (§147 AO)
Once you switch from paper to digital invoicing, you also need GoBD-compliant archiving under the Grundsätze zur ordnungsmäßigen Führung und Aufbewahrung von Büchern, Aufzeichnungen und Unterlagen in elektronischer Form (BMF-Schreiben 2019, updated 2024):
Practical implication: paper invoices you receive must be scanned and stored as PDF within a reasonable time. BMF accepts "unverzüglich" (without delay), interpreted as 1-2 weeks. Storing the paper plus scan is acceptable; storing only paper is acceptable but the scan is your working copy.
| Rule | What it means |
|---|---|
| 10-year retention | All invoices, contracts, receipts retained 10 years per §147 Abs. 3 AO |
| Tamper-evident | Once archived, no edits — invoice PDFs must be stored as flat (non-editable) files with timestamps |
| Traceable | You must be able to produce any invoice within a Finanzamt audit (typically 7-day response window) |
| GoBD-compliant software | Use DATEV, sevDesk, Lexoffice, or comparable; "email folders" are NOT compliant |
| Backup / disaster recovery | 3-2-1 backup (3 copies, 2 media, 1 offsite) is the de facto standard |

FAQ
Can I just start invoicing in Germany with no Steuernummer? Technically no — every invoice must include a Steuernummer or USt-IdNr per §14 UStG, and the Finanzamt issues the Steuernummer only after you register (via the Fragebogen zur steuerlichen Erfassung form, submitted through ELSTER). In practice, new freelancers issue a few "pre-Steuernummer" invoices with a note that the number will follow — but this is risky for VAT purposes and should be resolved within 4 weeks of starting work.
Do I need a Gewerbeanmeldung if I'm a §18 EStG Freiberufler? No. §18 EStG Freiberufler are exempt from Gewerbeanmeldung under §14 GewO (Gewerbeordnung). Submit the Fragebogen to your Finanzamt and that's it. If you later take on trade-side work, you register a Gewerbe separately and may need to amend your Einkommensteuererklärung.
What if my client is outside Germany and has a USt-IdNr — do I still charge VAT? No — if the client is a B2B customer in another EU country with a valid USt-IdNr, you issue the invoice net (no VAT) under Reverse Charge (§13b UStG) and write "Reverse Charge — Steuerschuldnerschaft des Leistungsempfängers" on the invoice. You must still file the ZM (Zusammenfassende Meldung) listing all reverse-charge transactions. For B2C customers outside Germany or non-EU B2B, the rule differs — most exports to non-EU are zero-rated (§4 Nr. 1a UStG, "Ausfuhrlieferung"), but service exports follow §3a UStG rules.
Do I have to file a Umsatzsteuervoranmeldung if I'm Kleinunternehmer? No, this is the main benefit — §19 UStG explicitly exempts Kleinunternehmer from UStVA filing (and from Umsatzsteuererklärung). You still file the Einkommensteuererklärung annually with Anlage S (for §18 EStG) or Anlage G (for Gewerbe).
What is the €22,000 / €50,000 Kleinunternehmer threshold based on? It's the net (VAT-exclusive) Umsatz from the previous calendar year, with a forward-looking €50,000 estimate for the current year. The "Umsatz" here means all consideration for deliveries and services — excluding VAT and excluding ancillary items like interest. The thresholds have not been raised since 2003; the EU VAT in the Digital Age (ViDA) review, expected in 2027, may unify them upward to €85,000 across the EU.
What if I accidentally charge VAT while being Kleinunternehmer — can I keep it? No: if your invoice contains a USt-IdNr or shows VAT being charged, the Finanzamt treats you as opted-in to Regelbesteuerung for the entire calendar year (§19 Abs. 3 UStG opt-in fiction). You must remit the collected VAT and then submit the year-end Umsatzsteuererklärung. The "I was just sloppy" defense does not work. Always include the literal §19 sentence on Kleinunternehmer invoices.
Do I need Steuerberater (tax advisor) for simple freelance work? For basic Kleinunternehmer with a single client and low complexity: probably not. Once you cross Freigrenzen / thresholds, have multiple income sources, or are uncertain about Gewerbe / Freiberufler classification: yes. A Steuerberater costs €1,200-€3,000/year for a single freelancer but saves €5k-€20k/year in errors. The Bundessteuerberaterkammer (BSK) maintains a searchable Steuerberater-Suche tool.
What about the new 2025 e-invoicing mandate — what format should I use? XRechnung for B2G (government) clients (often required even for sub-€250 amounts) and either XRechnung or ZUGFeRD 2.x for B2B. ZUGFeRD embeds an XML invoice into a PDF — so you can keep visually-identical PDFs for B2C and have the same file be machine-readable for B2B. Most freelance template tools need a ZUGFeRD 2.x add-on to comply; flat PDFs without embedded XML are not compliant from 2028.
